No Guarantee of Exchange Success
While Simple 1031 LLC facilitates 1031 exchanges in accordance with IRS regulations, we cannot guarantee the successful completion of any exchange or the deferral of capital gains taxes. Successful tax deferral depends on strict compliance with IRS Section 1031 rules, including:
- The 45-day identification deadline
- The 180-day exchange completion deadline
- Proper identification of replacement properties
- Meeting all other IRS requirements
Failure to meet these requirements may result in taxable gain.
FDIC Insurance Limitations
Exchange proceeds are held in FDIC-insured bank accounts. However, FDIC insurance is limited to $250,000 per depositor, per bank. For exchange proceeds exceeding this amount, funds may be distributed across multiple banking institutions to maximize FDIC coverage. It is your responsibility to understand FDIC insurance limits and how they apply to your exchange funds.
